These Terms of Service (“Terms”) govern your access to and use of the Site, purchase of our products, and engagement with our services (collectively, the “Service”).

By accessing the Site, placing an order, or using our products, you agree to these Terms. If you do not agree, do not use the Site or our products.

Our store is hosted on Shopify Inc., which provides the e-commerce platform.

SECTION 1 – ONLINE STORE TERMS

You represent that you are at least 18 years old or the age of majority in your jurisdiction.

You agree not to use the Service for any illegal, unauthorized, or prohibited purpose or in violation of any applicable laws.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

We may modify, suspend, or discontinue any part of the Service at any time without notice.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without our express written permission.

Credit card and payment information is encrypted during transmission.

Our products, including cooling underwear with removable or reusable ice packs, are designed for general comfort, cooling sensation, and wellness support during activities such as sauna use, heat exposure, or everyday wear.

They are not medical devices or health treatments.
They are not intended to diagnose, treat, cure, mitigate, prevent, or manage any disease, condition, or symptom.
They have not been evaluated or approved by the FDA or any regulatory body.

We do not provide medical or health advice. If you have concerns about temperature exposure or personal tolerance, consider consulting a qualified professional before use.

Always read and follow the instructions and warnings provided with your product.

SECTION 5 – PRODUCT SAFETY, TEMPERATURE EXPOSURE RISKS, AND ASSUMPTION OF RISK

Use of our products involves risks associated with temperature exposure and personal tolerance, particularly in hot environments (e.g., saunas or steam rooms) or with contrast between heat and cooling. Potential risks include skin irritation, discomfort, numbness, thermal shock, dizziness, fainting, or other adverse reactions.

By purchasing or using our products, you acknowledge and agree:

  • Cooling packs must never be applied directly to bare skin for extended periods — use the provided barrier or fabric as instructed.

  • Limit use duration, monitor your body’s response, and discontinue immediately if you experience discomfort or unusual symptoms.

  • Do not use if you are unsure about safe use or have concerns related to temperature exposure.

  • You assume all responsibility and risk for proper and safe use, including following instructions.

  • Use is entirely at your own risk. We are not liable for any injury, damage, or loss arising from use or misuse.

  • You acknowledge that individual responses to temperature exposure may vary.

SECTION 6 – ORDERS, BILLING, AND ACCOUNT INFORMATION

We may refuse or cancel orders for any reason, including pricing errors or stock issues.

You agree to provide accurate, current billing and shipping information.

Prices and availability are subject to change without notice.

SECTION 7 – SHIPPING, DELIVERY, AND RISK OF LOSS

Delivery estimates are approximate only and are not guaranteed.

Risk of loss or damage transfers to you upon carrier delivery confirmation.

We are not responsible for delays or issues caused by carriers, customs, force majeure events, or factors beyond our control.

Due to the intimate and hygiene nature of underwear, returns or exchanges may be limited or prohibited once worn or used, except for manufacturing defects.

To the fullest extent permitted by law, we and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or products.

Liability is limited to the amount you paid for the product in the twelve (12) months preceding the claim (or $100, whichever is greater), where permitted by law.

SECTION 15 – INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Amicus Holdings LLC, Arctic Underwear, and affiliates from claims or damages arising from your breach of these Terms, misuse of products, violation of laws, or infringement of third-party rights.

SECTION 16 – DISPUTE RESOLUTION AND ARBITRATION

Binding Arbitration & Class Action Waiver

Any dispute arising from these Terms or your use of the Site or products shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Arbitration shall occur in Denver, Colorado, unless conducted remotely by agreement.

  • You waive any right to a jury trial or participation in class or representative actions.

  • 30-Day Opt-Out: You may opt out of arbitration by mailing written notice to our business address within 30 days of first accepting these Terms. Include your name, address, email, and clear statement opting out. Please reach out to support@arcticunderwear.com for business address. 

This clause survives termination.

SECTION 17 – FORCE MAJEURE

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, supply disruptions, labor disputes, or government actions.

SECTION 18 – SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

SECTION 19 – ENTIRE AGREEMENT; NO WAIVER

These Terms and linked policies constitute the entire agreement between you and us. Failure to enforce any provision does not waive future enforcement.

SECTION 20 – GOVERNING LAW

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

SECTION 21 – CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance.
